INSTANTSPOT FREE HOSTING ADDITIONAL TERMS OF SERVICE

Free Users will also be bound to our Standard Terms of Service.

WHEREAS provides the service (the "Service") of hosting World-Wide-Web sites in exchange for the right to place advertisements on the Web sites;

1. Advertisements. User agrees that InstantSpot has the right to place small advertiseing on each page of the Site. Advertisements may also appear in a pop-up window. User agrees:

  1. not to remove, modify or interfere with the display of these advertisements in any way;
  2. to display the advertisements in their original form at all time; and that InstantSpot has the right to include traffic from the Site when accounting for total InstantSpot traffic.

2. Limitations. The InstantSpot Free Hosting Plan is subject to the following additional limitations:

  1. File Size. Files larger than 256 kilobytes are not permitted on the InstantSpot servers;
  2. File Types. User shall not host multi-media file types, including but not limited to MP3, Mpeg, AVI, Real Audio, Real Video, Quick Time, Windows Media and / or PDF files. User shall also not host executable binaries and / or compressed file types including but not limited to .EXE, .ZIP, .TAR, .RAR, .GZIP;
  3. User shall not include content, or internet links to content on the Site that contain, promote or involve any of the following:
    1. password restricted pages that are not available to the entire Internet community at large;
    2. mpeg layer two or three files (MP2 or MP3);
    3. storage of log files on non-html content;
    4. any use of space that does not allow, or interferes with, the display of advertising;
    5. any binary files that are not linked to an html page on the Site;
    6. any links from other providers' web pages to user's Site that do not first link to an html page on InstantSpot.
  4. Bandwidth. User is limited to a bandwidth restriction of 1 giga-byte (GB) per month, with a maximum limit of 56 megabytes (MB) per day; When USER reaches 80% of either the daily or monthly bandwidth limit, an automated warning e-mail notification will be sent to USER informing USER that USER's bandwidth limit has almost been reached; once a site exceeds bandwidth limit a default InstantSpot page will appear on USER's Web site with notice that the site is temporarily unavailable. In the instance of the daily bandwidth limit being exceeded, USER's Web site will be reactivated 24 hours from the time of deactivation. In the instance of the monthly bandwidth limit being exceeded, USER's Web site will be reactivated only upon request. If USER upgrades to any InstantSpot paid hosting plan, USER's Web site will be immediately reactivated.
  5. CGI Usage. Custom CGI scripts are limited to a maximum of 600 executions per day. Where the CGI execution limit is exceeded, access to USER's CGI scripts will be disabled for a period of 24hrs. USER's CGI scripts will be enabled immediately if USER upgrades to one of the InstantSpot paid hosting plans.

4. Termination. InstantSpot may terminate this Agreement, discontinue the Service and delete the Site at any time without notice to User in any of the following circumstances: a) There is no activity such as hits or edits on the Site for 60 days; b) User deletes, modifies or interferes with the display of advertisements by InstantSpot on the Site; c) User violates any other provisions of these terms of service.
